1. Acceptance of these terms

By using this website, submitting a contact form, calling or texting us, or purchasing a membership, class, or training session from Empire MMA Gym & Fitness (“we”, “us”, “our”), you agree to these Terms of Service. If you do not agree, please do not use the website or our services.

2. Services

Empire MMA Gym & Fitness provides gym memberships, martial-arts classes, and personal training in Tampa, FL, including (but not limited to) MMA, Brazilian Jiu-Jitsu, boxing, kickboxing, and strength and conditioning. Membership pricing, terms, and any waiver requirements are confirmed in writing when you sign up.

3. SMS / text messaging program

The following terms apply to our SMS messaging program and are intended to comply with TCPA, CTIA messaging guidelines, and A2P 10DLC carrier requirements.

a. Program description

Empire MMA Gym & Fitness sends customer-service text messages from a U.S. local number through HighLevel (LeadConnector) and Twilio. Messages may include: trial class confirmations and reminders, class schedule updates, membership and billing notices, follow-up after you visit, replies to questions you sent us, and occasional service updates relevant to your account.

b. Consent

By submitting your phone number through our website forms, by texting us first, or by checking a consent checkbox, you provide express written consent to receive SMS messages from Empire MMA Gym & Fitness at the mobile number you provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of purchase. You represent that the mobile number you provide belongs to you and that you are authorized to consent to receive messages at that number.

c. Message frequency

Message frequency varies based on your interaction with us. You may receive several messages around the time of a scheduled class or sign-up and fewer (or none) otherwise.

d. Cost

Message and data rates may apply based on your mobile carrier plan. Empire MMA Gym & Fitness does not charge a fee for the messages themselves. Carriers are not liable for delayed or undelivered messages.

e. Opt-out (STOP) and help (HELP)

You can cancel the SMS service at any time. Reply STOP to any message you receive from us and you will be unsubscribed. You will receive one final confirmation message and then no further texts. To rejoin, sign up again as you did the first time, or text START to the same number. For assistance, reply HELP or contact empiremmagym@gmail.com / (813) 992-0842.

f. Supported carriers

Supported on all major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, and Alltel. Carriers are not liable for delayed or undelivered messages.

g. Privacy

We do not sell, rent, or share your phone number or SMS opt-in information with any third parties or affiliates for their own marketing or promotional purposes. Mobile information will not be shared with third parties for marketing or promotional purposes. See our Privacy Policy for full details.

4. Memberships and payment

Membership pricing and billing terms are confirmed in writing when you sign up. Recurring memberships bill on the schedule stated in your membership agreement. Past-due balances may be subject to a service charge to the maximum extent permitted by law.

5. Cancellations and rescheduling

If you need to cancel or reschedule a class or training session, please contact us as soon as possible. Membership cancellation terms are stated in your membership agreement.

6. Warranties and disclaimers

Any warranties are as stated in your written membership agreement. Except as expressly stated in writing, services and the website are provided “as is” without warranty of any kind, and Empire MMA Gym & Fitness disclaims all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, Empire MMA Gym & Fitness is not liable for indirect, incidental, special, or consequential damages arising out of or related to the use of this website, our SMS program, or our services. Our total liability for any claim relating to a service will not exceed the amount you paid us for that service.

8. Acceptable use of the website

You agree not to misuse the website, attempt to access it in unauthorized ways, scrape content, or interfere with its operation. Content on this site is owned by Empire MMA Gym & Fitness or its licensors and may not be reproduced without permission.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to that jurisdiction.

10. Changes to these terms

We may update these Terms from time to time. The “Effective date” above shows when it was last revised. Continued use of the website or our services after changes are posted constitutes acceptance of the updated Terms.
